Are ClubCorp fees worth membership

AGB AIRPORT CLUB FRANKFURT GMBH

§1

With the acceptance of the application for membership, a membership contract is concluded between the applicant and Airport Club Frankfurt GmbH, hereinafter also referred to as “Airport Club”.

§2

Membership entitles the holder to use the club's premises in accordance with the club's rules. The use of other facilities, such as currently z. B. Office, secretarial and conference services as well as the restaurant are available to members for a fee within the scope of the available capacities. In the case of corporate membership, the right of use is only available to the persons named in the application for membership. In the case of private memberships, however, a renaming of the family member and in the case of company memberships a renaming of the authorized persons named by the entrepreneur is permitted if the Airport Club agrees. The Airport Club agrees to renaming if there are no concerns about the named person with regard to the desired club atmosphere and all outstanding amounts from the membership have been settled.

§3

Membership requires payment of the admission fee. Furthermore, at the beginning of each year an annual membership fee has to be paid for membership during the calendar year. If you are accepted into the club from July 1st, only half of the annual fee will be charged. The amount of the admission fee and the annual membership fee result from the contribution rates applicable when the contract was concluded. The Airport Club can change the annual membership fee with effect from January 1st of the following year. A corresponding change will take effect from the new calendar year and must be communicated to the member six months before the end of the calendar year. Timely publication in the "Club News" is sufficient for the change to be effective.

The admission fee and the annual fee will not be reimbursed upon termination of membership.

§4

After paying the admission fee, each member receives a membership card that serves as proof of entitlement to use the club facilities and which entitles them to consume. The consumption is billed monthly. The member can choose to collect the invoice amount by direct debit or credit card. The membership card remains the property of the Airport Club and must be returned to it after membership has ended.

When entering the Airport Club, the membership number saved on the membership card as well as the date and time are recorded. Any consumption is also recorded for billing purposes. The Airport Club stores this data in compliance with the provisions of the Federal Data Protection Act

§5

Membership obliges to comply with the club rules, which every prospective member receives before joining and which is displayed in the club. These club regulations and the general terms and conditions can be changed by the Airport Club for objective reasons. A corresponding change will take effect from the new calendar year and must be communicated to the member six months before the end of the calendar year. Timely publication in the "Club News" is sufficient for the change to be effective.

§6

The membership contract can be terminated by both parties with a notice period of three months to the end of each calendar year, otherwise the membership is extended by a further calendar year. The right to extraordinary termination for good cause remains unaffected. A termination must be in writing to be effective. The admission fee and the annual fee will not be reimbursed in the event of termination.

§7

The Airport Club is generally not liable for any damage suffered by the member. This does not apply to liability for a breach of an essential contractual obligation and for liability for damage to the member from injury to life, limb or health or for damage resulting from an intentional or grossly negligent breach of duty by the Airport Club, its statutory representatives or vicarious agents. Essential contractual obligations are those whose fulfillment enables the proper execution of the contract in the first place and on whose compliance the contractual partner can regularly rely. An essential contractual obligation of the Airport Club is, in particular, but not exclusively, the continuous access to the premises mentioned in § 2.

The member is asked to take care of any valuables and their cloakroom themselves. The Airport Club does not assume any security or duty of care for such objects.

§8

Oral agreements in addition to this contract have not been made. Any change to this contract must be made in writing. This also applies to the cancellation of the written form clause itself.

§9

German law applies. The court of jurisdiction is Frankfurt am Main.
